DELAY:
Unless the parties agree otherwise in writing, the carrier shall not be liable for any special consequential of other damages caused by more delay in the delivery of the shipment regardless of the cause of such delay.
LIMITS OF LIABILITY:
Licensed & Insured ($100 Maximum Liability, Additional Insurance Available )
Carriers shall not be liable for any loss, damage, destruction or unreasonable delays arising from the following causes:
- Acts of God, or public enemies
- Riots
- Strikes
- Authority of law
- Defect or inherent vice in the goods shipped
- Act of default of the shipper or owner of the goods
- Nuclear reaction, radiation or radioactive contamination
DECLARED VALUE OF SHIPMENTS:
Carrier’s liability for any loss, damage or injury to a shipment shall not exceed lesser of $1.50 per pound or $50 unless:
The shipper and carrier specifically agree otherwise in writing and the shipper or class of shippers is named in carrier’s cargo insurance policy or;
The carrier shall not be required to accept any shipment with a declared value in excess of $500 unless agreed to prior in writing by the carrier.
Unacceptable Shipments
Shipper agrees that its Shipment is acceptable for transportation and is deemed unacceptable if:
-It is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA ( International Air Transport Association ), ICAO ( International Civil Aviation Organization ), any applicable government department or other relevant organization;
-No customs declaration is made when required by applicable customs regulations; or
-RSTransport Inc. decides it cannot transport an item safely or legally.
NOTICE OF LOSS DAMAGE:
Notice of loss damage must be given to the carrier at its regional office, or its head office within twenty-four (24) hours after such loss or damage becomes known, and in writing thirty (30) days after the shipment is accepted by the carrier.
NOTE: NO LIABILITY FOR LOSS OR DAMAGE WILL BE ACCEPTED BY THE CARRIER UNLESS WRITTEN NOTICE OR SUCH LOSS OR DAMAGE IS RECEIVED WITHIN THIRTY (30) DAYS AFTER THE SHIPMENT IS ACCEPTED BY THE CARRIER. |
